    Legal Advice

Post by DavesaRam on Thu 01 Oct 2015, 6:11 am

I am acting as guarantor for someone who has missed some rental payments. So far I gave paid one month with the likelihood if one or two more.

What rights do I have in law to pursue him to get my money back?

I don't know, but thinking logically I would imagine that a lot depends on the wording of the guarantor agreement. If I were you I would go to the citizens advice bureau sooner rather than later if only to make sure that he doesn't continue to miss payments, especially if he thinks that you have to pay, without consequence to him.

You need to check what it says in the agreement that you signed as his guarantor. For
example, how long does the agreement last for? If you didn't sign anything, then there is no
    legally enforceable contract.

Here's what the Citizen's Advice Bureau says about it - it's about guarantors for students but
the principle is the same for any similar type of contract.

Student housing – using a guarantor

This page is better, being aimed more towards guarantors and their rights and responsibilities -

    Being a Guarantor
